Probate 

In Florida, probate is the court-supervised process of identifying and gathering the assets of a deceased person, paying the deceased individual’s debts, and distributing all assets to eligible beneficiaries.

Probate helps with the distribution of assets if the decedent left a valid will. If the decedent did not leave a valid will, probate law will assist those who do not have a formal structure in place to distribute the assets of their loved one.

First, the decedent’s assets are used to pay for the probate proceedings, then the assets are used to pay the decedent’s debts, and lastly, whatever is left is distributed to the decedent’s beneficiaries.

We plan with you to avoid probate and there are many ways in Florida to do so; including revocable living trusts and retitling assets.
